Terms of Service
Please read these terms
entirely. This document contains important information about our payment
policies and what is considered acceptable use of our network.
In this document, "We" and "Our" shall refer to, iSight,
Inc (D/B/A 250Host). "You" and "Your" is the person legally eligible to sign-up for
services at 250Host.
Unsolicited Mail
Unsolicited Mail, a.k.a. "SPAM", is not
allowed at 250Host. You may not reference 250Host, any 250Host member, or
URL linking to any 250Host network site in a mass mailing, mass newsgroup
posting, or any other form of unsolicited electronic communication. You may not use your mail account for
mass unsolicited mailings.
Unacceptable Content
250Host offers customers great freedom in
what they can post on sites. But we have some restrictions in what we
deem to be unacceptable content.
Hate:
Content which promotes hate or violence of any topic, including
gender or race, is strictly prohibited.
Obscene Material:
Content that is considered obscene under U.S. Federal and
Local law is prohibited.
Intellectual Property:
You agree that all content on your site was authored by you, or you
have received permission to use the material. Your site may not contain
material you do not own or do not have permission to use. This includes
material that is: copyrighted, trademarked, protected by trade secret,
protected for the sake of national security, or other content protected by
intellectual property rights.
Reasonable Use
We strive to make your site load as reliably
and quickly as possible. Accounts that excessively tax server CPU or
memory resources may be asked to upgrade to a more appropriate service.
Network Security
Unauthorized use, probing, or scanning of
data to obtain sensitive information, test the vulnerability our systems
or network is strictly prohibited. Unauthorized monitoring of our
network, systems, or users of 250Host is strictly prohibited.
Software Restrictions
Form Mail
You may only use FormMail v1.91 or higher due to security
concerns with earlier versions
IRC
Due to excessive resource usage, IRC programs are not
permitted on shared-server accounts.
Illegal Use
250Host may be used only for lawful purposes.
Transmission, distribution or storage of any material in violation of
any applicable United States law or regulation coming to or from any
unauthorized network or system is prohibited. This includes, without
limitation, material protected by copyright, trademark, trade secret or
other intellectual property rights used without proper authorization;
government and military data protected by law and national security;
university and academic data protected by public policy; and material that
is obscene, defamatory, constitutes an illegal threat, or violates export
control laws. Any violation of the above which compromises the integrity
of 250Host or any other network is strictly prohibited. 250Host will
cooperate fully with local and federal authorities in the investigation
and prosecution of illegal activity.
Payment
Services are offered on a pre-paid basis at
250Host. Payment for services is due on the first of every month. An
account becomes overdue if the amount due is not paid in full by the tenth
of every month. Overdue accounts are subject to service suspension, as
well as a finance charge not to exceed 10% of the amount due.
250Host is a recurring service.
This means your service obligation will continue unless you contact
250Host with a request to cancel service at least two days before your
next billing period is due. Please see our
Contact page for official
methods to contact 250Host. You will be responsible for paying any
overdue charges as well as late fees that may be associated with the
overdue amount. For accounts paid by credit card, you agree to have the
amount due for services automatically deducted from your card each billing
period.
Domains registered under your account
will renew automatically unless you explicitly contact 250Host requesting
to cancel renewal. You will be invoiced for the domain renewal at
least thirty days before its current expiration, and notice of the
domain's pending expiration will be sent to the Admin and/or Billing email
contact listed on the domain. You may cancel domain registration up to
fifteen days before the domain's current expiration date.
Refunds
250Host backs its commitment to serving
you with our Personal
Service Guarantee. For full details, please
visit this page. During
the first 30 days of service, if you are not fully satisfied, you may
request a full refund of the original hosting package price. This offer
excludes domain registration fees and additional fees, including excess
bandwidth usage charges or custom services. Requests for refund must be
made at the time of service cancellation.
Refunds will be given for remaining unused months of pre-paid services,
provided you contact us at least two days before your next billing
period. Unless explicitly stated, refunds are not given for the current
month of service. Service may be cancelled at any time by
contacting us.
Support
As a service business, 250Host
realizes support is a central feature of web hosting. We are committed to
ensuring you have a positive experience as a client of 250Host. When you
purchase services from us, you also receive a commitment that we will be here to
assist you should you need it. For web hosting, we are happy to help with
the functioning of your account, including issues logging in, understanding the
functions of hosting features, and basic assistance with the setup of your
hosting account. 250Host also provides domain support free of charge.
This includes assistance with logging in to manage your domain, updating your
WHOIS information, and adding nameservers. We ensure the products that we
directly sell will function as advertised. 250Host's primary method of providing support
is through email or a support ticketing system. We offer a telephone contact number, though
we cannot always guarantee availability of support through this method.
Extended Support
Except as noted, support does
not extend to issues such as configuring scripts or providing web site design
assistance. At our discretion, we sometimes may provide good faith
assistance and guidance for general site building questions. As well, some
of our products may include extended support consultation. The details of
that extended support will be described with that product. For non-supported
issues, you are welcome to post your question in our Help Forum and other
members may be willing to assist. You may also contract the consulting services
of 250Host at a rate of $50 per hour, billed in 15 minute increments. An
example of support requiring extended consultation would be a request for
250Host to install and configure a shopping cart system.
Installatron disclaimer:
250Host provides the powerful Installatron automatic script installer at no
charge with DirectAdmin hosting accounts. This feature allows simple
installation of many of the most popular scripts on the Internet. While
250Host provides this service free of charge, we do not include support for
configuring the scripts that are provided with Installatron. We are also
not responsible for keeping scripts up to date, nor for any security
vulnerabilities that may arise from the installation of scripts included in
Installatron.
Network Reliability
250Host takes every reasonable effort to
ensure maximum hardware and network reliability. That said, the Internet
is an inherently unreliable medium. Should a problem stem from a gross
failure on our part, meaning hardware and networks directly under our
control, we may offer a pro-rated credit or refund for that time period.
Requests for credit must be made in writing or by telephone, within 15
days of the outage, and must include a description of the time period the
server was down.
Data Reliability
Data stored on our servers is backed up on
a daily basis. 250Host takes no responsibility for the data stored on
our servers. As an extra measure of safety, it is prudent for members to
regularly backup data stored at 250Host.
Compliance
Failure to comply with the terms stated
herein may result in suspension of service or account termination. Such
occurrence is subject to appeal and review by 250Host upon reasonable
explanation. Gross violators will have their account terminated without
refund.
Limit of Liability
You agree to hold 250Host and its parent
company, iSight, Inc., harmless for any damages incurred while using this
service. We will not be responsible for any physical, emotional, monetary
harm or damages that occur while at 250Host. You take all responsibility
for the content that you store and share at 250Host, and it is your
responsibility to ensure compliance with your Federal or National, and
Local laws. We may make changes to our policies at any time, without
prior notification to members. A link to our current terms will be
